Terms and Conditions

Acceptance of Terms

By accessing and using the Cruiseway.llc website, you accept and agree to be bound by the terms and provision of this agreement. These Terms and Conditions, together with your booking confirmation email (the "Booking Confirmation"), set out the legal terms on which cruise and train travel services are made available to you through our website.

Your use of our website is subject to these Terms and it is a condition of using our website that you accept these Terms. To book a cruise or train travel service, you must also accept these Terms. If you do not accept these Terms, then please do not use our website or book a travel service.

We may make changes to these Terms by updating them at any time and your continued use of our website after any changes come into effect will constitute your acceptance of the updated Terms. Any existing bookings will continue to be governed by the Terms that applied to your booking when the booking was made.

By making a booking, you agree on behalf of yourself and any third‑party adults and/or minors indicated in the reservation to be legally bound by these Terms and any additional terms and conditions of any independent contractor/supplier (cruise line or rail operator) that are applicable to your booking.

Definitions

For the purposes of these Terms and Conditions:

  • "Company", "We", "Us", "Our" refers to Cruiseway.llc, a luxury travel experience provider with registered office at 7361 Radcliffe drive, West Bloomfield township, Michigan USA 48322.
  • "Customer", "You", "Your", "Passenger", "Guest" refers to the individual accessing or using our website, making a booking, or travelling as part of a cruise or train package, including all persons named on a booking, their heirs, and representatives.
  • "Cruise Travel" refers to the cruise travel programme, including shore excursions, accommodation, and any ancillary services purchased through the Company.
  • "Train Travel" refers to any rail journey, rail pass, or train‑inclusive package booked via our website, including both domestic and international services operated by third‑party rail carriers.
  • "Service" refers to the website and all booking and information services provided by the Company.
  • "Travel Provider" refers to the cruise line, rail operator or other supplier making available travel services to you through our website.
  • "Fare" means the amount paid for the cruise, train ticket, and/or package and/or travel services and does not include fuel supplement charges, security charges, or similar assessments.
  • "Booking Confirmation" refers to the email confirmation sent by us detailing the essential elements of your booking.

Booking & Reservations

Cruise Reservations

To make a cruise reservation, you may book online through our website, contact our reservations department, or visit one of our authorised travel agents. The person making the reservation represents and warrants that all participants have consented to, accepted, and agreed to be bound by these Terms.

A binding contract between you and us only comes into existence when we send out our Confirmation Invoice. This invoice will show the balance due on your holiday, your travel details (where applicable), and the final payment date. Please check all details are correct as soon as you receive your Confirmation Invoice. If any details appear to be incorrect, you must inform us within 14 days of receiving the document.

Train Reservations

When booking train travel through our website, you are entering into a contract with the respective rail carrier, with Cruiseway.llc acting solely as booking agent. The carrier’s own conditions of carriage apply in addition to these Terms. A booking is considered confirmed only when we issue a ticket or confirmation number and full payment has been received.

You must provide accurate passenger information, including full legal name(s), date(s) of birth, and contact details. For international routes, passport or national ID numbers may be required at the time of booking.

Child and infant age policies vary by carrier. Generally, children under a certain age (often 4 or 5) travel free when sitting on an adult’s lap; dedicated seat tickets are required for older children. Please review the carrier’s specific policy before completing your booking.

Eligibility and Capacity to Contract

You must be at least 18 years of age to make a reservation and have the legal authority to enter into contracts. You represent that all information supplied by you is true, accurate, current, and complete. If you book on behalf of others, you will obtain their authorization prior to acting on their behalf and will ensure that they agree to, and will comply with, these Terms.

Guest / Passenger Information

Your full name, as it appears on your passport or government‑issued ID, must be given at the time of reservation. From time to time, we may be required to collect personal information relating to you and your party to pass on to immigration authorities, equivalent government bodies in other countries, and carriers (air, rail or cruise).

Pregnancy and Infants (Cruise)

Pregnant passengers are not permitted to travel if they will have entered the 24th week of their pregnancy by the beginning of, or at any time during the cruise. Infants must be at least 6 months of age at the time of embarkation in order to sail, and at least 12 months of age on transoceanic voyages and cruises of 14 days or more.

Passengers with Reduced Mobility or Medical Conditions

Any guest with any physical or mental condition, disability, illnesses, or other needs requiring medical special arrangements must notify the Company in writing at the time of booking. The Company reserves the right to refuse passage to any guest who has failed to notify their requirement for special treatment or assistance. This applies equally to cruise and train travel; please inform us of any accessibility needs (e.g., wheelchair space on trains) at the time of booking.

Group Reservations

Additional terms and conditions apply to group reservations (being a reservation with 8 or more participants for cruises, or 10 or more for trains). The Company provides these with the Group Policies at the time the group reservation is made or upon request.

Payment Terms

Cruise Payment Schedule

To reserve a cruise booking, a deposit is required at the time of booking. Deposit amounts vary based on, among other things, cruise duration, package selection, and stateroom category. Final payment is required by the final payment date specified in your Booking Confirmation, typically between 70 and 120 days prior to departure.

Non‑refundable deposit fares may be offered for lower prices; if you cancel, the deposit is forfeited.

Train Payment Schedule

Train reservations must be paid in full at the time of booking, unless otherwise stated. Some discounted or promotional fares require immediate payment and are non‑refundable. For certain multi‑leg or group rail packages, a deposit of 20‑50% may be accepted, with the balance due no later than 30 days before the first travel date. You will be informed of the exact payment deadline at the time of booking.

If full payment is not received by the due date, we reserve the right to cancel the booking and apply cancellation charges. All prices are quoted in US dollars and are subject to change until the booking is paid in full, except where a guarantee has been provided.

Late Payment

If we have not received all monies due to us in full and on time, you will be deemed to wish to cancel your travel and cancellation charges as set out below will be assessed. The Company reserves the right to cancel any booking not fully paid at the time final payment is due.

Price Changes & Errors

We reserve the right to correct any pricing errors on our website. If there is an obvious error and you have made a booking, we will offer you the opportunity to keep your booking by paying the correct price or we will cancel your booking without penalty.

Cancellation & Refund Policy

Cruise Cancellation

Cancellation charges for cruises vary depending on the cruise type, fare selection, and days to sailing. Standard schedule:

  • 70 days or more: No charge (except non‑refundable deposit)
  • 69 – 45 days: 50% of total price
  • 44 – 15 days: 75% of total price
  • 14 days or less: 100% of total price

Extended voyages and luxury packages may have different schedules, advised at booking.

Train Cancellation

Train ticket cancellation and refund rights depend on the fare type and rail carrier’s policies, which are incorporated into this agreement. As a general guide:

  • Flexible / refundable tickets: Can be cancelled up to 24‑72 hours before departure (depending on carrier) and refunded in full, less any administration fee.
  • Semi‑flexible tickets: Cancellation more than 24‑48 hours before departure allows a partial refund (typically 50‑75%), with a fee. Cancellation within 24 hours or after departure – no refund.
  • Non‑refundable / advance tickets: No refund or exchange is permitted after purchase, unless the ticket is covered by a separate refund protection scheme.

To cancel a train booking, you must contact us or the carrier directly. Refunds are processed to the original form of payment within 14 business days of receiving a valid cancellation request. In the event a train is cancelled by the operator, you are entitled to a full refund or re‑booking on an alternative service, subject to the operator’s conditions.

Refund Processing

Where applicable, refunds will be processed within fourteen days of cancellation. Refunds will be issued net of the applicable cancellation charge.

Cancellation by Company

The Company reserves the right to cancel any booking for any reason, including but not limited to insufficient participation, operational requirements, or force majeure. In such circumstances, we will offer you either a full refund of all monies paid or an alternative comparable travel package.

Travel Documents & Requirements

Passports, Visas and ID

It is the responsibility of each guest to obtain and carry all required travel documents. For international cruise and train journeys, a valid passport with at least six months’ validity beyond the travel dates is required. Some train routes (e.g., Eurostar, cross‑border European services) require passport control; you must carry the same document used for booking.

For domestic train travel, a government‑issued photo ID may be required for ticket collection and onboard inspection.

Immigration and Customs

Guests must comply with all immigration and customs requirements of the countries visited. The information you provide to us may be provided to public authorities such as customs or immigration if required by them, or as required by law.

Health Requirements

Guests are responsible for complying with all health requirements, including vaccinations, established by the countries visited. The Company recommends consulting the CDC or equivalent authority. For train travel, some countries may require proof of vaccination or negative test results; please verify the latest rules before departure.

Check‑in Requirements

For cruises, all guests must be checked in and onboard no later than 90 minutes before sailing. For trains, you must be present at the departure platform at least 30 minutes before departure (or 60 minutes for international services requiring security/passport checks). Late arrival may result in denied boarding and forfeiture of the ticket.

Travel Insurance

Guests are required as a condition of our accepting your booking to take out adequate and appropriate travel insurance to cover as a minimum all travel, cancellation, curtailment, medical expenses, repatriation, personal liability, and loss of or damage to luggage and personal property. This applies to both cruise and train bookings.

We strongly recommend that you purchase comprehensive travel insurance at the time of booking. The Company shall not be responsible for any costs, losses, or damages incurred as a result of your failure to obtain adequate travel insurance.

Liability Disclaimer

Limitation of Liability

To the fullest extent permitted by applicable law, the Company, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our services.

Supplier Liability

As agent, we accept no responsibility for the acts or omissions of the principal(s) or supplier(s) or for the services provided by them. The principal's or supplier's Terms & Conditions will apply to your booking.

Events Beyond Our Control

The Company shall not be liable for any loss, damage, delay, or failure to perform caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, industrial action, natural disasters, epidemics, pandemics, flight cancellations, or any other force majeure event.

Onboard Activities and Shore Excursions

All travel facilities, tours, activities, shore excursions, and other services arranged by independent contractors or third‑party providers are subject to the terms and conditions of such providers. The Company accepts no liability for any loss, damage, injury, or death arising from participation in such activities.

Train‑Specific Terms

Operating Carrier’s Conditions

All train journeys are operated by third‑party rail carriers. Your contract of carriage is with that carrier. In addition to these Terms, you must comply with the carrier’s conditions of carriage, including rules on luggage, prohibited items, behaviour, and refunds. The carrier’s conditions are available on their website or upon request.

Ticket Validity & Seat Reservations

Tickets are valid only for the train, date, and class of service indicated. Seat reservations are mandatory on many high‑speed and long‑distance trains. If you board without a valid reservation, you may be required to purchase a new ticket or pay a supplement on board.

Delays and Missed Connections

While rail operators strive to maintain punctuality, delays can occur. In case of delay, the carrier’s delay compensation policy applies. We are not liable for missed connections unless a protected through‑fare was booked. We strongly recommend allowing ample connection time (minimum 60‑90 minutes) between separate train services or between train and flight/cruise. Any additional costs arising from a missed connection are the passenger’s responsibility unless covered by travel insurance.

Luggage & Personal Belongings

You are responsible for your luggage at all times. Rail carriers generally permit 2‑3 pieces of luggage and one small carry‑on per person, but size/weight limits vary. Oversized or excessive luggage may be refused or subject to additional fees. The Company and the rail carrier are not responsible for lost, stolen, or damaged luggage, unless directly caused by our negligence.

Special Trains & Packages

For luxury train packages (e.g., Orient‑Express, Rocky Mountaineer) or inclusive rail tours, additional terms apply regarding payment schedules, cancellation charges, and included amenities. These will be communicated at the time of booking and form part of your contract.

Intellectual Property

All content included on this website, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of the Company or its content suppliers and is protected by international copyright laws.

Permission is granted to temporarily use the materials on the Company's website for personal, non‑commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose, or for any public display (commercial or non‑commercial)
  • Attempt to decompile or reverse engineer any software contained on the website
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by the Company at any time.

Changes to These Terms

We may update our Terms and Conditions from time to time. We will notify you of any changes by posting the new Terms and Conditions on this website. You are advised to review these Terms and Conditions periodically for any changes. Changes to these Terms and Conditions are effective when they are posted on this page.

Any existing bookings will continue to be governed by the Terms that applied to your booking when the booking was made.

Governing Law

These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non‑contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms and Conditions or the website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Michigan. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

For travel services provided by third‑party suppliers, the terms and conditions of those suppliers may specify different governing law and jurisdiction provisions. You agree to review those terms carefully before making a booking.
